Terms of Service

1. Agreement to Terms

By accessing or using the Tanka platform (the “Service”), operated by Tanka Technologies Inc. (“Tanka”, “we”, “us”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

Tanka provides a cloud-based Transport Management System that includes fleet management, trip and dispatch management, fuel tracking, maintenance scheduling, compliance and safety management, driver management, financial costing, and analytics modules. The Service is delivered as a Software-as-a-Service (SaaS) solution accessible via web browsers and mobile applications.

3. Account Registration

To access the Service, you must create an account with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised access or use of your account.

4. Subscription and Pricing

4.1 Plans

The Service is offered under tiered subscription plans (Starter, Professional, Enterprise) priced per vehicle per month. All plans include access to the full platform with unlimited users. Plan details and current pricing are available on our Pricing page.

4.2 Billing

Subscriptions are billed monthly or annually in advance. You authorise Tanka to charge the payment method on file for all amounts due. Annual subscriptions receive a 15% discount. Prices are quoted in US Dollars and may also be displayed in local currency for reference.

4.3 Fleet Size Changes

You may add vehicles to your subscription at any time, with charges prorated for the remaining billing period. Vehicle reductions take effect at the next billing cycle.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use the Service to transmit malware, viruses, or other malicious code
  • Resell, sublicence, or redistribute access to the Service without written consent
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload false, misleading, or fraudulent data intended to misrepresent operational performance

6. Your Data

6.1 Ownership

You retain all rights to the data you upload to or generate through the Service (“Your Data”). We do not claim ownership of Your Data.

6.2 Licence

You grant Tanka a limited, non-exclusive licence to process, store, and display Your Data solely for the purpose of providing and improving the Service. This licence terminates when your subscription ends and your data is deleted per our retention policy.

6.3 Data Export

You may export Your Data at any time during your active subscription through the platform’s export features. Upon subscription termination, we will make Your Data available for export for 30 days before permanent deletion.

7. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is the intellectual property of Tanka Technologies Inc. Nothing in these Terms grants you any rights to Tanka’s intellectual property beyond the limited right to use the Service under your subscription.

8. Service Availability

We target 99.9% uptime for the Service, measured monthly. Scheduled maintenance windows will be communicated at least 48 hours in advance. We are not liable for downtime caused by factors outside our reasonable control, including internet connectivity issues, third-party service failures, or force majeure events.

9. Support

All plans include standard support via email during business hours (Monday–Friday, 8:00 AM – 6:00 PM EAT). Professional and Enterprise plans include priority support with faster response times. Enterprise plans include a dedicated customer success manager. Support response time targets are outlined in the applicable Service Level Agreement provided during onboarding.

10. Termination

10.1 By You

You may cancel your subscription at any time through the platform or by contacting support. Monthly subscriptions terminate at the end of the current billing period. Annual subscriptions are non-refundable but remain active through the end of the prepaid term.

10.2 By Tanka

We may suspend or terminate your account if you breach these Terms, fail to pay fees when due (after 14 days written notice), or if we reasonably believe the account is being used fraudulently.

11. Limitation of Liability

To the maximum extent permitted by law, Tanka’s total liability for any claims arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or lost data, even if we were advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold Tanka harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms or the Service shall be resolved through arbitration in Nairobi, Kenya, under the rules of the Nairobi Centre for International Arbitration (NCIA).

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email and posted on our website at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
